These Terms of Service (“Terms”) govern your access to and use of the software platforms, services, and website operated by NetForge LLC (“NetForge,” “we,” “us,” or “our”). By accessing or using our services, you agree to be bound by these Terms.
1. Description of Services
NetForge LLC develops and operates software platforms for the petroleum services and oilfield industry, including a field technician dispatch, scheduling, and CRM platform. Services are provided to business clients (“Clients”) and their authorized users (“Users”), including field technicians who use the platform to receive job assignments and scheduling updates.
2. Eligibility
You must be at least 18 years of age and authorized to enter into a binding agreement to use our services. If you are using our services on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.
3. Accounts and Access
Access to our software platforms requires an authorized account provided by your employer or the Client organization. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. SMS Messaging Terms
NetForge operates an automated SMS notification service for field technicians dispatched through our platform. The following terms apply to all SMS communications sent by or through NetForge:
- Opt-In Required: You will only receive SMS messages from NetForge if you have explicitly opted in through your employer’s platform, a written consent form, or another opt-in mechanism provided by your Client organization.
- Message Types: Messages may include job dispatch notifications, schedule updates, reporting reminders, and other operational communications related to your field service assignments.
- Message Frequency: Message frequency varies based on dispatch activity and may change day to day.
- Rates: Message and data rates may apply. Contact your mobile carrier for details.
- Opt-Out: Reply STOP to any message to unsubscribe. You will receive a single confirmation message and no further SMS messages will be sent to that number.
- Help: Reply HELP to any message for assistance, or contact us at the address below.
- Supported Carriers: Major US carriers are supported. Delivery is not guaranteed on all carriers or devices.
- No Third-Party Sharing: Your mobile number and opt-in status will not be shared with or sold to any third party for marketing or promotional purposes.
5. Acceptable Use
You agree not to use our services to:
- Violate any applicable law or regulation
- Transmit unauthorized or unsolicited communications
- Interfere with or disrupt the integrity or performance of our platforms
- Attempt to gain unauthorized access to any system or account
6. Intellectual Property
All software, content, and materials provided by NetForge are the property of NetForge LLC or its licensors. You may not copy, modify, distribute, or reverse engineer any part of our platforms without prior written permission.
7. Disclaimer of Warranties
Our services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. We do not warrant that our services will be error-free or that SMS messages will be delivered in all cases.
8. Limitation of Liability
To the maximum extent permitted by applicable law, NetForge LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our services, including any failure of SMS message delivery.
Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the amount paid by your Client organization to NetForge in the three months preceding the claim.
9. Governing Law
These Terms are governed by the laws of the State of Mississippi, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Lee County, Mississippi.
10. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a revised effective date. Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
